This article discusses a controversial doctrine—accepted by some federal courts but rejected by others—that allows removal to federal court even in the absence of complete diversity of citizenship if the defendants can demonstrate that the nondiverse party was improperly joined in violation of Federal Rule 20 or the comparable state joinder rule.
In this article, Professor Lund discusses the doctrine’s history and demonstrates the current split among courts over whether to recognize it, focusing on the Fourth Circuit, where district court decisions are deeply divided. He then presents his arguments on why federal courts should refuse to recognize the doctrine.
